Not only does Jones Day give Sherwin Williams crappy legal advise, Jones Day can’t protect Sherwin Williams’ trademark or IP. Jones Day can’t even protect their own name from misuse or their own IP. Now here’s a retarded-ass Jones Day attorney move. Big Pat McCartan sues Blockshopper because Blockshopper put a link to Jones Day on their website. Big Pat claims that any current Jones Day client, or prospective client, will think that Jones Day sponsors and is a part of Blockshopper. Along comes www. We Betray America .com, puts a hot-link on its website, tells everyone that Jones Day is an essential part of www. We Betray America .com, and openly challenges Big Pat and Jones Day to come and sue them. But the cowards and assholes they are, Big Pat and Jones Day hide under the skirts of Managing Partner, Mama Steve Brogan.

Painting and Decorating Contractors of America, www. PDCA Dishonest .com, hires law firm SNR Denton. On behalf of PDCA, SNR Denton attorney, Samuel Fifer, writes the most stupid, dumb-ass legal document of all time. First, although he’s writing to an individual, he addresses the letter “Ladies and Gentlemen”. Most ludicrous, Attorney Fifer (Little Sammy) demands “an apology and retraction to all members of the PDCA”, and to “anyone else” the “Ladies and Gentlemen” has ever offended. Often, when lawyers try to be funny, they usually just brag about how really stupid they are. Current honors go to Eric Stroz, co-founder (along with Edward Friedberg) of Stroz Friedberg. Front man Eric boasts, when bragging about the new law firm, “we’re former law enforcement guys. We have some brains, some muscle. We’re not afraid of adversarial situations.” Well, their “some brains”

sure don’t have any muscle. Eric and Edward hire John Reed Stark to join their inner sanctum. When John-Boy was a SEC attorney, John-Boy was Mama Steve Brogan’s pet attorney and when Mama Steve said jump, John-Boy quashed SEC investigations of Jones Day and client Sherwin Williams. (Well, since Eric and Edward need criminal knowhow and a jump-to-it Mama’s Boy, maybe Eric has “some brains” after all.) But on the other hand, Eric’s “We’re not afraid of adversarial situations” evidences a total lack of even “some brains”. In September 2010, New Mountain Capital invested $115 million in Stroz Friedberg and in return, New Mountain Capital received approximately 50% ownership of Stroz Friedberg; the remaining ownership shared by Greenhill Capital Partners II. According to Alok Singh, Managing Director of New Mountain Capital, the key stimulus for this investment is that “Stroz Friedberg is a company with a sterling reputation based on the superior quality of its work and its people.” Although Stroz Friedberg’s expertise in digital forensics and digital risk management may be sterling, Stroz Friedberg also has the reputation for criminal and unethical activity. www. John Reed Stark is a former SEC attorney. As a SEC attorney Mr. Stark used his position of power for personal favor. In 2009, Mr. Stark stopped two official SEC investigations; one against Jones Day, and the other against Sherwin Williams. When first asked about these investigations, Mr. Stark maintained that the investigations were completed but that the results were unavailable. Requests under the Freedom of Information Act revealed that no SEC investigations were ever conducted. When questioned again, Mr. Stark maintained that were no investigations and that if there were investigations, all documents were destroyed. Mr. Stark subsequently lied to US Senators Lieberman and Dodd. Either Eric Stroz and Edward Friedberg failed in conducting due diligence of Mr. Stark, or Stroz Friedberg needed Mr. Stark’s professional connections and his expertise in deceitful and unethical behavior. It’s no wonder that the Stroz Stupid and Friedberg Flam Axiom, refering to “willful incompetence” is widely known in the legal community.

Stroz Friedberg’s relationship with John Reed Stark is certainly repugnant, most likely unethical, and betrays the trust placed in Stroz Friedberg by New Mountain Capital and Greenhill Capital Partners II. Receipt of this document acknowledges both New Mountain Capital’s and Greenhill Partners’ II awareness and acceptance of John Reed Stark’s criminal past and unethical character and his employment by Stroz Friedberg.

The Stroz Stupid and Friedberg Flam Axiom is, of course, named after Eric Stroz and Edward Friedberg, and is the legal community’s recognition of the Stroz Friedberg “Janus Policy”. Their public denial of Mr. Stark’s criminal activities are the watermarks of “willful incompetence” or “contrived stupidity”. The Stroz Stupid and Friedberg Flam Axiom has become the widely accepted legal term for “willful blindness”. (Some attorneys call it “chromosomal stupidity”.) And though Eric Stroz and Edward Friedberg may glory in their legal notoriety, any village idiot knows the Stroz Stupid and Friedberg Flam Axiom is a jackass’ excuse for lie, fraud, and deceit. (Maybe being a card-carrying jackass is the crowning achievement of their lives.)

The Stroz Stupid and Friedberg Flam Axiom also involves “malicious ethical deception”, or “lawless ethics”. This term refers specifically to the intentional misuse of ethics in marketing wherein a fraudulent ethical platform (Code of Ethics and Standards) is established solely to beguile the public and/or investors without consideration of subsequent harm or damage. For Eric Stroz and Edward Friedberg “malicious ethical deception” is common business practice.

Eric Stolz and Edward Friedberg are dumb-on-target, each trying to out-jackass the other in willful blindness/willful ignorance. Since contrived stupidity is so intrinsic to Eric and Edward, the Stroz Stupid and Friedberg Flam Axiom are widely accepted synonyms in the legal and business communities for willful blindness.
